12. He that strikes a man, so that he dies, shall be surely put to death.

13. And if a man does not lie in wait, but God delivers him into his hand, then I will appoint you a place where he shall flee.

14. But if a man comes presumptuously upon his neighbor to slay him with guile, you shall take him from My altar so that he may die.

15. And he that strikes his father or his mother shall surely be put to death.

16. And he that steals a man and sells him, or if he is found in his hand, he shall surely be put to death.

17. And he that curses his father or his mother shall surely be put to death.

18. And if men strive together, and one strikes another with a stone, or with his fist, and he does not die, but is confined to his bed;

19. If he rises again and walks abroad upon his staff, then he that struck him shall be set free. Only he shall pay for the loss of his time and shall cause him to be completely healed.

20. And if a man strikes his servant or his maidservant with a rod and he dies under his hand, he shall surely be punished.

21. But if he continues a day or two, he shall not be punished, for he is his money.

22. If men strive and strike a pregnant woman, so that there is a miscarriage, and no harm follows, he shall surely be punished, according as the woman’s husband will lay upon him. And he shall pay as the judges determine.

23. And if any injury occurs, then you shall give life for life,

24. Eye for eye, tooth for tooth, hand for hand, foot for foot,

25. Burning for burning, wound for wound, stripe for stripe.

26. And if a man strikes the eye of his servant, or the eye of his maid, so that it perishes, he shall let him go free on account of his eye.

27. And if he strikes out his manservant’s tooth, or his maidservant’s tooth, he shall let him go free on account of his tooth.

12. 不論用任何方式導致人死亡,就被判以死罪。

13. 人若不是出於陰謀鬼計的傷害,耶和華是會放手,留他一條出路。

14. 若有人出於私意,謀殺了他的鄰舍,可以帶到祭壇前作出判決,理由充份可以判以死罪。

15. 毆打自己父母,可以處以死罪。

16. 拐騙並把人售賣,當場被發現,鐵證在手,可以處以死罪。

17. 詛咒自己父母,會被處死。

18. 有二人彼此毆鬥,有人用石頭或拳頭打傷另一人,該把他監禁起來。

19. 若當中有其他人參與打鬥,被打傷的人可以得到該有的賠償,包括時間上和復完須要的費用。

20. 有人用棍棒怒打他僕人或婢女,以致因而死亡,這人要有該得懲罰。

21. 若處置是因為懲戒,只一兩天的事,只因是金錢買來,不應去報仇。

22. 有相互歐鬥,傷及孕婦,致其流產,未造成其他傷害,傷人者該受懲治,至於用何種方式,可以由孕婦的丈夫決定該如何作出補償。

23. 傷人性命,要以命償命,

24. 眼還眼,牙還牙,手還手,腳還腳,

25. 燒傷還燒傷,傷口還傷口,鞭傷還鞭傷。

26. 若僕人或婢女的眼睛被弄瞎失明,就還他/她人身自由。

27. 若僕人或婢女的牙齒被打掉,就還他/她人身自由。

這段是有關人與人起爭執時,當以什麼原則處理,它同樣分成二部份:同胞和傭工。按這些家規的描述,似乎是外傭是用於幫助家務,而胞同一是自己處理一是聘用而來。

從12-19是對同胞之間出現的爭執該用什麼原則處理,而外傭是另一種,記載於20-26節。

由12-19節判罰的原則,似乎就是今日英國採用的普通法的原則,是人與人之間這樣的自然關係。判罰的原則是用常理及一般邏輯,不用細膩分類,明顯易見的對錯事件。

以色列人是明文規定不可作買賣人口的生意,16節認為是須受重刑處置。

由20-26節是關乎外傭犯事時的處理。它沒有像以色列人自己犯事是的處理方式。這不涉及公平的問題。因為在當時的社會大環境,有這種情況出現,就不是一個人可以改變。只是作為有過為奴經驗的以色列人,這樣的安排,是有阻嚇作用。犯事的方式很多樣化,就用一個簡單的原則:以牙還牙,意思是導致什麼樣的後果,就以此作為懲治的方式。

這方式簡單易明,因為不用將事件放官府審理,是當時法例容許的處理方式。處理的人,在當時是可以任由自的喜好,而以色列人有過這樣的經歷,就不要以不明大能者的慈愛,把血氣的事施之外傭身上。

以色列人聽耶和華的話,就是盡了自己的責任:愛人如己。愛人不是只有縱容,現代人將自己的責任,用愛作掩飾。
